Preemption is a powerful strategy used by special interest groups to undermine strong, local public health standards. Currently, 20 states in the U.S. have preemption ordinances in place related to clean indoor air initiatives. These preemption laws are the direct result of an ongoing and aggressive campaign of tobacco companies to thwart clean indoor air initiatives, which ultimately, according to tobacco industry internal documents, cause significant reductions in their annual revenues. Clean indoor air policies have arisen from a greater understanding (...) of the documented health risks associated with exposure to secondhand smoke and action by local government to protect the public from these hazards. The efforts of the tobacco industry undermine local authority and seek to shift policy action to the state and federal levels, where the industry has greater political influence. (shrink)

In a recent critique of informed consent, Robert Veatch argues that the practice is in principle unable to attain the goals for which it was developed. We argue that Veatch's focus on the theoretical impossibility of determining patients' best interests is misapplied to the practical discipline of medicine, and that he wrongly assumes that the patient-physician communication fails to provide the knowledge needed to insure the patient's best interests. We further argue that Veatch's suggested alternative, value-based patient-professional pairing, is, (...) on his own terms, impossible to implement. Interest in John Maynard Keynes has increased significantly over the past decade with the publication of his collected writings, increased access to his unpublished papers, and the resulting explosion of secondary literature. Responding to this renewed attention, this collection brings together economists and historians of economics with scholars from philosophy and other related fields to reconsider Keynes’s work and its legacy. The various cosmological proposals by Einsteinian relativists seek to show the structure of the world as a consequence of the basic notions of relativity. In particular, the irrelevance of the state of motion of an observer to his description of the fundamental laws of nature is to be maintained. Furthermore, gravity is understood as being a description of the fact that particles move along certain minimal paths in non-Euclidean space. In this theory, the effect of one material particle on another (...) particle in the old-fashioned sense of gravitational attraction becomes indirect; that is, a particle moves on a minimal path in a space having a degree of curvature dependent on the material entities which exist in it, rather than having its path bent by the attraction between it and other material bodies, all of them existing in an absolute or receptacle-like space. The spirit is in and of nature and can never lift the self outside of nature. For Corrington's ecstatic naturalism, there is no realm of the supernatural, only dimensions and orders within nature.

Aristotle contends that in perception the sense organ is “made like” its object, but only “in a certain way.” Much controversy has surrounded these remarks, primarily about how to understand being “made like.” One camp has understood this to require literal exemplification, such that the sense organs manifest the sensible qualities of their objects. Others have understood likeness to require no physical alteration at all in the sense organs.I accept as a starting point in this paper that understanding perceptual likeness (...) in terms of exemplification is a non-starter. By doing so, however, I also reject the easiest and most direct understanding of what it means for the sense organs to be “made like” their objects. Others who have shared this assumption have suggested that likeness consists in “isomorphism.” Unfortunately, they have not adequately explicated how this notion is to be understood, with the result that Aristotle’s theory of perception remains crucially underdeveloped. I argue that the key is to understand the form of isomorphism at work in Aristotle’s account of thinking. (shrink)
